Terms of Service for Aquarium AI

Welcome to Aquarium AI (the "App"), a mobile application and web platform owned and operated by Capital City Aquatics, LLC ("we," "us," or "our").

By downloading, accessing, or using the Aquarium AI App, you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Description of Service

Aquarium AI is an aquatic management tool designed to assist both new and experienced aquarists. The App provides features including, but not limited to, aquarium calculators (volume, salinity, alkalinity), an AI Chatbot, an AI Fish Compatibility Tool, an AI Stocking Assistant, tank management ("My Tanks"), and AI-powered Photo Analysis.

2. "Bring Your Own Key" (BYOK) Model & Third-Party Services

Aquarium AI operates using a "Bring Your Own Key" model. To access the App’s artificial intelligence features, you must provide your own API key(s) from supported third-party providers (e.g., Google Gemini, OpenAI, Groq).

  • Billing and Costs: You are solely responsible for any and all costs, fees, and usage limits associated with your API keys. Capital City Aquatics, LLC is not responsible for overages, billing errors, or account suspensions issued by your API provider.

  • Third-Party Terms: By using third-party API keys within our App, you agree to comply with the respective Terms of Service and usage policies of those AI providers.

  • Key Security: The App stores your API keys locally on your device or securely within your account. We do not use your API keys for our own purposes, nor do we share them with unauthorized parties. However, you are responsible for maintaining the confidentiality of your API keys.

3. Disclaimer of AI Accuracy and Aquatic Risk (Assumption of Risk)

Aquarium AI provides automated, AI-generated guidance and mathematical calculators intended to assist you in managing your aquarium. However, keeping aquatic life involves unpredictable biological and chemical variables.

  • No Guarantee of Survival: We do not guarantee the health, survival, or compatibility of any aquatic life, plants, or invertebrates based on the recommendations provided by the App.

  • Not Professional Veterinary Advice: The AI Chatbot, compatibility tool, photo analysis, and stocking assistant are informational only. They are not a substitute for professional aquatic veterinary advice, independent research, or the expertise of a qualified aquatic biologist.

  • User Responsibility: You are solely responsible for verifying the accuracy of all calculator outputs (e.g., dosing amounts, salinity conversions) and AI-generated advice before applying them to your aquarium.

  • Limitation of Liability for Damages: Capital City Aquatics, LLC shall not be held liable for any loss of livestock, tank crashes, equipment failure, water damage, or any resulting financial losses arising from your reliance on the App’s information, calculations, or AI outputs.

4. User Accounts and Privacy

To use certain features (like "My Tanks"), you may need to create an account.

  • You are responsible for safeguarding your login credentials.

  • When using the Photo Analysis feature, please be aware that images you upload are transmitted to your designated third-party AI provider (e.g., Google or OpenAI) for processing. Do not upload photos containing sensitive personal information.

5. Acceptable Use

You agree to use Aquarium AI only for lawful purposes. You shall not:

  • Reverse engineer, decompile, or disassemble the App.

  • Attempt to bypass any security features or exploit bugs within the App.

  • Use the App to generate malicious, illegal, or harmful content via the AI API integrations.

  • Reproduce, duplicate, or copy any proprietary calculators, algorithms, or visual designs owned by Capital City Aquatics, LLC.

6. Intellectual Property

All content, branding, design, logos, and proprietary calculators within Aquarium AI (excluding the user-provided AI outputs generated by third parties) are the exclusive intellectual property of Capital City Aquatics, LLC, protected by copyright, trademark, and other applicable laws.

7. App Updates and Modifications

We reserve the right to modify, update, suspend, or discontinue any feature of the App at any time, including adding premium or subscription-based features in the future (such as Dosing Diaries or Ad-Free experiences). We may also update these Terms periodically. Continued use of the App following any changes constitutes your acceptance of the new Terms.

8. Limitation of Liability and Indemnification

To the maximum extent permitted by law, Capital City Aquatics, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of the App.

You agree to indemnify and hold harmless Capital City Aquatics, LLC and its owner, Nicholas W., from any claims, damages, liabilities, and expenses arising out of your use of the App, your
